Hi everyone, 

i'm actually having some troubles with the rules of chess.

 
Here's a diagram to illustrate where my brother and I got stuck.

He believes its checkmate.
I think that the white king can still move to the right, near the queen.

Who's right ?

Your brother is right....

It depends which way the pawns are moving.  If white's pawns move up the board, then yes it is checkmate (Kb3 is illegal since it puts white's King in check by black's Queen).  Alternatively, if the the white pawns move down the board, it is not checkamate since gxh8 captures black's checking rook.

I can understand  why you might have thought otherwise. The thing is the (pinned) black queen can "take" the white king before the white rook can "take" the black king.

It is an instructive position for newer players to understand.

His queen could notionally move since your king dies before his.

You could set the postion up on computer just to confirm for yourself...
