Forcing a draw when your opponents next move is check mate is unsportsmanlike and it should result in a loss for the person who initiates it.
Every game I have played that ended in a draw was because my n3xt move would have been check mate so what do they do check check check check and it's worse when I only have 1 legal move sometimes 2.
So yeah whoever starts the rep8tion should lose the game not the other person's fault they can't win
Both players have to repeat and either are free to deviate. If deviation would lose the game then repeating is the best course of action.

If you didn't calculate properly and blundered to allow a draw in a winning position, it's your fault you didn't win. Same as if you didn't calculate properly and allowed stalemate.
