Nope. The three-position repetition rule requires that the castling and en passant properties must also be the same.

At first glance it looks like 2: Re4+ is much, much better.

But you're correct about castling, it is indeed not yet three repetiion.

USCF and FIDE both define a position as "A set of legal moves." If the set of legal moves changed, it is not the same position.

I completely forgot that the d file would still be covered by the rook if the queen moved.
