(1) Would you call it cheating if someone who has not disabled (or has enabled) the premove function does not make any premoves? (2) And how about the promotion function (always queen on promotion)? Since it cannot be made mandatory should it be deleted? It is an advatage to use it for you 1) save some time, 2) avoid underpromotions by misclicks (it has happened to me), 3) will almost always promote your pawn to a queen, nonetheless.
(1) No, I would not consider it cheating. Even though one may not intend to make any premoves, as long as the function is enabled there is the chance that one may make a premove unintentionally as a result of a misclick.
(2) That is a good question, and admittedly one that I did not initially consider. As you pointed out, it cannot be made mandatory - so I would suggest that it be removed entirely, to eliminate scenarios where one player in a game has the function enabled, while his or her opponent has it disabled. I think it is debatable whether the function is an advantage or a disadvantage, but if it is eliminated entirely then both players would have the exact same advantage or disadvantage, and so it wouldn't matter which one it is.
Although I have no idea whether you are serious or just trolling I like your consistency. Consequently, if you are about to ask the Chess.com staff to make the changes please do not forget to mention also the SUBMIT button in online (correspondence) games. It makes it possible to play a move on the board and cancel it afterwards which is something I would not be allowed to do OTB. If we carry on for a while I believe we will find more issues and problems.
The answer is straight and simple: Disable playing chess.
