Let me explain:
1. An award of a draw for repetition is not automatic, it has to be claimed. I know other websites automatically award a draw but they have bastardized the Laws of Chess.
2. You claim a draw by clicking on the draw button. If the necessary criteria have been met, then a draw will be awarded.
No claim = no draw.

And having to click on a draw button is not a bastardized version of the laws of chess?
I get your point, if I was playing over the board I would claim the draw and only if the other player disagreed would I request a ruling (arbitration). I understand the rules, I just don't see a clear indication of how it was explained on this system and what the procedures were to obtain the desired result. So maybe I should say the feature is not well documented.
In either case it still sucks!
