Player announces checkmate in OTB game when not checkmate

In a recent game of mine my opponent made a move which he believed was checkmate. He held out his hand to shake mine, to conclude the match. I had very little time and shook his hand, thus 'resigning'. To my horror I realised I had a distant bishop that could capture his supposed mating piece. Presumably it's too late once you shake hands and resign, but I was technically 'tricked', not deliberately I believe, into resigning. After a discussion with my opponent we agreed to a draw, which was kind of him. Does anyone know the rule in this circumstance.

8.7 At the conclusion of the game both players shall indicate the result of the game by signing both scoresheets or approve the result on their electronic scoresheets. Even if incorrect, this result shall stand, unless the arbiter decides otherwise.

This happened to me once. He held his hand above the chessboard when he thought he checkmated me. I shook his hand then captured his piece, and continued playing to win the game. If he would have made a problem about it, I would tell the arbiter I thought he held his hand out to resign.
