The agreement you made is 7 days per move, plus vacation time. Because that's how it works on chess.com, and you started a chess.com game.
You can't just claim he agreed to something else just because you weren't aware of vacation, that's unfair to him.
It's always impossible to improve on Scarblac's formulation.
For tournaments, you can restrict yourself to playing in no-vacation tourneys.
For ordinary games, there is no no no no no no-vacation option (though it's been on the wishlist e.g. post #120 here).
