I'm not a lawyer, no idea which law. I just assumed it was fraud. There was some who wants to be a millionaire cheater, I believe he was prosecuted. Don't know if he went to jail or not. But come to think of it, it was the British version. So can't say for United States.

Yeah the law probably would be fraud or fraudulent inducement or something like that, but the question is do the facts of what the kid did meet the elements of fraud? I think not. Sounds more like breach of contract if anything.

Even without engine, if somebody can move the pieces in a small board in his PDA he would have an unfair advantage, because it would be easier for him to look at the moves ahead!
if you are using a recording device, you're supposed to make the move first, then record, so that theoretically should preclude someone from looking moves ahead.
You make a move and I'm deep in thought. Seems I keep forgetting to record your moves until I glance at my device and notice it's not the current position. So I fiddle with it. Soon after I make a very strong move in a critical position

Still can't believe it took so long to catch him. I tend to notice when some 1200 rated kid destroys me in 25 moves and my computer thinks he's a chess genius.
