Why when you are playing someone that plays the same move 42 times is there not a stalemate. I just played a guy and for the last three minutes of the game we were doing the exact same move. Why will chess.com not change this awful situation?

You probably meant 'three-fold repertition' and not 'stalemate'. Stalemate happens when it is a player's turn but he has no legal move to play, whereas threefold repetition happens when the exact positions is repeated three times consecutively. So back to the question in hand, assuming you are wondering why draw wasn't issued because of threefold repetition, you have to press 'offer draw' to claim the draw. That is, assuming the game was played on Chess.com.

It's 50 moves without a pawn push or capture, and it's not a stalemate.
