It should just be declared a draw before move 1 because both sides have equal position and time.
This is why chess.com is a joke - draws by insufficient material

I'm not sure he was attacked for his ignorance of a rule - a lot of people here ask about rules without being savaged (and in rereading the posts, I don't find anything particularly demeaning in the responses) - as much as for his pugnacious approach and assumption of correctness. A more civil tone on his part might have garnered more civil responses. I suspect he'll be back, maybe as UKUmbrage.
if your opponents time runs out but you have have just your king (or there is no known mate with your pieces) then it is a draw. you cant win that on time. actually that time is given to your opponent to checkmate you, so its not you who lost an opportunity but your opponent.

Well, he didn't ask a question, nor even make a comment in a civil way. Just assumed his right to play around with no pieces and expect to win a game of chess on time was correct and that everyone running the site is basically an idiot. When people ask questions they usually get an answer. When they just act like a jerk they tend to get replied to in kind too.

I am new to the site and using an Apple IPad. My problem is when playing an opponent I cannot see my time clock which is very disconcerting. I try sliding the screen up but to no avail. Anybody know what I am doing wrong.

So my post was to state how odd it was to let time run down to zero before declaring it a draw. For the last 2 mins of the game I recognised my opponent had the upper hand, so i was intentionally trying to win on time, nothing else. As far as the community comments, do you really think I'm at all affected by your comments?! If anything most of them amused me!
What would you suggest instead? Declaring it a draw before he/she ran out of time?
