I don't think they ban people for being jerks. Usually they warn them first.

Worse is when I've reported people for repeated and blatant TOS violations and they're not banned.

If someone is repeatedly and blatantly violating the Terms of Service, please report them directly to the Support team via https://support.chess.com/article/346-contact-us; it should be easy for Support to investigate, assess, and take the appropriate action. The same should be done for any urgent one-off incidents that people identify; the Support team will normally respond by the next business day.

Reporting members via their profile using --> More --> Report does not go to a Support team member, but the report is saved and recorded. There are various trigger points when people accumulate certain numbers of these reports where they are automatically warned and/or muted for a period of time. There are other Staff who review the accounts with the most number of abuse reports and decide whether further action is warranted.

Depending on the nature of the issue, Chess.com generally prefers to have a dialogue with our members to help them understand why what they're doing is outside the Terms of Service and can therefore avoid doing that in the future; obviously we don't do this for particularly egregious behaviour or for Fair Play violations, which have a separate process.
