Bug in Live Chess

Alright, I had this position with maybe 10 sec on each of our clocks. (I am black)

At this point he flags. Now, the reason why I didn't take the pawn is because it gave me winning chances. The game could have continued as so:

But, as I'm sure you can guess, this game was called a draw by insufficent material. While the chances of this happening are next to zero, it is still possible, and according to the rules, should not have been drawn. Thoughts?

Chess.com uses slightly different rules than you're used to (whether they are the FIDE rules or the USCF rules, which differ from each other on this matter).  Chess.com only looks at one side's material: Lone King, K+B, K+N, K+2N all result in insufficient material, regardless of if there is a helpmate possible or not.
