I believe that the points we are getting when someone cheated in a game are not fair as they should also add the points if we won.

There is no guarantee you would have won in a fair game though. In fact, you have the same chance at winning as losing if the opponent was truly rated at your level. The rating refunding is more like a nice gesture, but it doesn't really impact the rating system long-term anyway because your ability didn't change from one unfair game.
