I don't think it would be unfair to play out, given that it is possible the opponent could have used their time differently, so I guess it is your call...

King and Rook vs. King and Rook, 10 seconds vs .1 minute on the clock.
According to the rules it is not a draw because of the rooks but effectively it is, or should be after 50 move.
Is it fair to play out, if the player with 10 seconds ask for a draw?
