insufficient material draw

The difference is that in the first game, you must have run out of time.  They call the game a draw because there was no possibility that your opponent's lone king could have ever mated you, no matter how badly you played.

That was not true in the second game.  As long as you both have time, the game can continue. However, if your opponent's time were to run out, it would be judged a draw.
