I see what you are saying, but this actually happened in one of the games I played in Live Chess, and it seems you would've stopped my trap.
this game could not have happened,white E pawn is missing and black would have to have missed a move, or black would have retreated his/her back row.
It's a puzzle, meant to confuse, not nessesary to be true, but to make us think.

Thanks, but the game was real, I forgot to take out the c-pawn from black. Here is how it got set-up
