Sure its a puzzle. Just don't move the pieces. This IS a puzzle under definition too, so if your're looking for a non-solution puzzle, there are a few out there.

I know, it was a stupid late night comment, what I meant was that the puzzle was a bit to easy, but when I think back some years, it would be tough enough.
