There are 2 main arguments against this:
1. You probably also have games where the position was a likely draw and you ended up winning on time. Everyone probably has had multiple games where they were almost getting mated but won on time, or were about to give checkmate but lost on time, so it all cancels out. Just today I had a game where the person had an easy mate in 1 and ran out of time. I also clearly remember a game I played where I had 3 queens but still lost on time because I had 1.3 seconds left and my opponent still had a couple pieces and pawns LOL.
2. While I agree positions with almost identical pieces and extremely high drawing chances would have been a draw without the time issue, the question then becomes where do you draw the line? You'd have to make specific exceptions for positions varying from basic endgames to theoretically drawn endgames that you have to play perfectly to hold the position, as well as taking into account the ratings of both players and the amount of time each person had left. Queen vs Queen is a really simple draw, but with only 2-3 seconds it's easy to fall for a skewer, blunder, or even a mate on the edge. An opposite colored bishop endgame, which is slightly harder to draw may be easy to draw if both players have say, 30 seconds left. This would be extremely complicated and require arbitration by humans from the site. The servers are already hitting max capacity very frequently. This is why you have to have a strict rule, as long as checkmate is possible in any way, it's a win for the side that still has time left on the clock.
One thing I would criticize the site for is not recognizing actual DRAWN positions, such as the following:
In this position checkmate will never be possible by either side, yet this site does not automatically draw such games. This position is DRAWN, not "drawish" and ironically, chess dot com does draw positions of knight vs bishop where mate is theoretically possible for both sides...it shouldn't. It has to be all or nothing.
