1. When 3 Move Repetition occur, does the game draw immediately? Or does it need the agreement of both sides?

2.When playing OTB, a player (on thier turn) grabs thier piece and BEFORE completing their move says:"check!" , but immediately places the piece on another square (a square that doesn't allow check), is this legal?

1. I believe when 3 fold repetition occurs either player may claim the draw. If neither claims I think the game continues. If one disagrees that it has occurred then the clocks are stopped whilst the arbiter checks the scoresheets.

2. Firstly it is poor form to announce check. This would probably fall into the category of unreasonable behaviour intended to distract the opponent, particularly if it was not even a check. Thus you could pause the clock and appeal to the arbiter.
