GDPR

GDPR collectively refers to the European Union (“EU“) and the United Kingdom (“UK“) General Data Protection Regulations.

Personal Information or PI

“Personal Information“ as used herein means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. This could include an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of a natural person, to the extent one or more of these data points can be used to identify that person. Throughout this Privacy Policy, we use the terms “Personal Data“, “Personal Information,“ and “PI,“ interchangeably to refer to the same concept.

Usage Data

Usage Data is data collected automatically either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit). Usage Data may include pseudonymous data where applicable.

Opening a Chess.com Account and Using Basic Services.

We may collect the following categories of personal information when you open an account with us and use our Services, without competing in sanctioned games or winning prizes:

Personal identifiers: name or alias used; email address; username and password; IP address; country; preferred language; status as a student (yes/no); information related to customer reviews; and any other information the User chooses to share in the “About me“ section of the profile;

Commercial and financial information: information about the form of the actions Users take and activities they complete when using the Services; information about patterns of usage and order history; information about interactions with the Sites; information about Services and Products accessed, considered, or purchased; interactions with other members, friends and coaches on the Services; player-related information including data about contribution points, rating levels or points, OTB rating, awards achieved, membership in our clubs, penalties or suspensions, complaints received; data regarding blogs maintained on Chess.com and elsewhere. In addition, payment information such as credit or debit card information and billing address is collected from Users who purchase a subscription, including those who gift a paid Account to others, unless Users are purchasing through Apple AppStore, PayPal, or other similar mechanisms with which we integrate. For your security, we do not store your credit card number in our databases but we and our payment service providers may retain only the first six digits and/or last four digits to identify your Account and respond to your requests and questions and to process the payment

Internet or other electronic activity information: information that your browser sends to us whenever you visit our Service or information we receive when you access the Service through a mobile device (“Usage Data“). This Usage Data may include your IP address, browser type, browser version, operating system, device type, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers, your country, language preferences, your chess statistics and other diagnostic data

When you access the Service by or through a website, including on a mobile device, this Usage Data may also include information about how you got to our Website, your approximate geolocation, and the websites you visited prior to visiting the Services. When you download and use one of our Apps, we may also track and collect App usage data, such as the date and time the App on your device accesses our servers and what information and files have been downloaded to the App based on your device number

Competing in Chess.com Sanctioned Games and Prize Winners

In addition to the personal information collected above, when you compete in sanctioned games, including when we must verify the identity of Users, and when you win prizes, we may collect the following additional categories of personal information about you:

Personal identifiers: Identifiers relating to chess services including OTB rating, USCF or FIDE ID numbers and titles; social media handles; driver's license or other governmental ID; social security number or similar tax ID number, signature, address and other information on governmental forms provided to us to prepare Form 1099 documents for prize winners

Commercial and financial information: Information about prizes redeemed and prizes

Internet or other electronic activity information: When you participate in competitive events, the monitoring software that is required to be used will collect information about your mouse and cursor movements, device processes, and tabs

Biometric information: facial images collected during game monitoring

Audio and visual and electronic information: video and other visual images captured during game play, video conferences and/or monitoring conducted in connection with competitive events; input and output audio and images of your device screen collected during competitive event monitoring

Interactions with Vendors and Suppliers and Others in Business-to-Business Context

We may collect the following categories of personal information about individuals that represent entities with which we do business, including suppliers, vendors, and similar companies:

Professional information: job title, information about your employer from our vendors and suppliers

Sensitive Personal Information Collected: Laws in various jurisdictions have different definitions of “sensitive information“ or “sensitive data.“ The following types of Personal Information that we collect may constitute “sensitive information“ or “sensitive data“ under one or more of those laws: Social Security numbers; driver's licenses or other governmental IDs; biometric identifiers.

If you are located outside the US: Residents of the UK and EEA have a right to object to the processing of their personal information where that processing is carried out for our legitimate interests. Please note, however, that we may not be able to fulfill such requests in all instances. Residents of other non-US jurisdictions may have a similar right. Notice at Collection: Categories of Personal Information We Sell or Share or Use for Targeted Advertising

When we engage in digital advertising in the United States, we may sell the following categories of personal information (according to the broad definition of “sell“ under select state privacy laws), share them for purposes of cross-context behavioral advertising, or use them for targeted advertising: personal identifiers (including IP address, mobile advertising IDs, mobile push tokens) and internet or other electronic activity information.

These categories of Personal Information are sold to or shared for cross-context behavioral advertising or targeted advertising with advertising networks, data brokers and other companies that facilitate or engage in digital advertising. We engage in such sales and sharing to facilitate personalized advertising. We do so by allowing third parties to place cookies or other tracking technologies on our Sites and in our advertisements which may collect information about your interactions with our Sites, advertisements, and your online activities over time and across different websites or applications. We do not sell or share for cross-context behavioral advertising or use for targeted advertising any of the other categories of Personal Information we collect.

Notice at Collection: Retention Periods

We retain personal information for as long as necessary to provide our Products and Services and fulfill the transactions you have requested, or for other business purposes, to comply with our legal obligations, resolving disputes, and enforcing our agreements. We decide how long we need to retain personal information informed by the following factors when making retention decisions:

  • Whether we need to keep personal information to maintain, close, or reopen accounts;
  • Whether we are required by law to keep some types of personal information for certain periods of time to comply with our legal obligations; and
  • Whether we need certain types of personal information to prevent harm and ensure safety and security of our Sites; investigate possible violations of our policies and Terms of Use; or to protect the company.

3. Sources From Which We Collect Personal Information

We and our service providers collect information that Users provide when using the Services, including when Users create an Account, sign up for Services, sign up to obtain a student discount, or contact us with a question, comment, or request.

This includes when Users complete their profile with additional information, which is optional, such as: first and last name, approximate location, country, language, content language, timezone, OTB rating, profile picture and any other information the User chooses to share in the “About me“ section of the profile. The flag of the country you choose will appear on your profile.

Keep in mind that certain information from your profile is public and therefore can be accessed by any User, and even by people outside Chess.com. By including information in your profile, you understand that the information that is public can be used by any person or entity for their own purposes.

We also allow Users to register an Account by connecting with external third-party services such as Google, Apple, or Facebook. If you choose this way of registration, we may receive your personal information from these third parties, including but not limited to your name, email address, and contacts.

In addition, Users can provide us with information through separate sections of the Services. These sections, accessible via the Menu or Settings link on the Services, allow Users to administer their Accounts, including when they provide testimonials, seek customer support, or submit comments or questions.

If you submit any information relating to other people in connection with the Services, you represent that you have the authority to do so and permit us to use the information in accordance with this Policy.

When you contact us directly by any means we will collect your email address, name and any information you provide.

In addition to information we collect from Users, we also collect personal information from representatives of entities with which we do business or may do business. We may also collect personal information from third parties, such as our advertising and social media partners.

4. Cookies and Other Technologies

We use “cookies“ and other similar technologies, some of which are essential for our Website to function. Cookies are small, sometimes encrypted, text files that are stored on computer hard drives by websites that you visit. They are used to help users navigate websites efficiently as well as to provide information to the owner of the website, and for digital advertising. If you are in the EEA or the UK, for non-essential cookies, we will only use these if you provide your opt-in consent through our cookie banner or preference tool.

Additionally, Google uses cookies to serve ads on our Service. Google's use of the DoubleClick cookie enables it and its partners to serve ads to our users based on their visit to our Service or other websites on the Internet. 5. No Profiling to Facilitate Decisions with Legal or Other Significant Effects

We do not engage in the automated processing of Personal Information to create profiles about individuals that are used in furtherance of decisions with legal or other similarly significant effects, such as the provision or denial of financial or lending services, housing, insurance, or access to essential goods or services.

6. Use or Disclosure of Sensitive Personal Information

We do not use or disclose sensitive or special category Personal Information to create profiles about or infer characteristics about individuals, or for any purposes other than providing our Services.

7. Biometric Identifier Notice

We collect facial images and fingerprints that may be on ID cards in order to identify Users who participate in competitions we host. We retain information to be able to verify Users who are engaged in competitions and will delete such information upon request. We may disclose these identifiers to our service providers that assist us in operating our identity verification program and to our cloud storage provider.

8. Disclosure of Personal Information for Business Purposes

9. Notice of Financial Incentives

We may offer special incentives to Users who enroll in certain promotions. The availability of these promotions to you at any given time will vary. If we offer such programs, we may ask for your PI as a prerequisite to your participation in the promotion so that we can provide promotions to you

10. Personal Information of Children

We do not intentionally or knowingly collect or maintain information from persons under the age of 13.

11. Your Privacy Rights

Any User can review or change the information they provided when they registered for the Services by updating the information on their Account profile. You also can exercise your right of access by requesting it on the “My data“ Section of our Services.

When we change any PI at your request, we will make reasonable efforts to make the changes in our then-active databases as soon as reasonably practicable and always within the applicable legal timeframe. Changing settings options may not result in immediate changes to the settings, which are subject to our operations and maintenance schedules.

We reserve our right to refuse requests where permitted by law, including where requests are manifestly unfounded, clearly abusive, malicious, repetitive or excessive.

12. How to Cancel and Delete your Account and How to Request Reactivation

Users may cancel their Accounts at any time by using the “Manage Account“ section in the settings.

Please bear in mind that after an Account is canceled, the PI and other Account information is not deleted permanently. We store the User information to allow the User to reopen their Account at any time. However, we provide no guarantee, and shall have no liability or obligation to ensure, that all Account Information and Services-related progress will be available or accessible or all learning or personalization features will be able to be recovered or resumed.

You can request to permanently delete your PI by clicking on “Delete“ on the “My Data“ section of the Services. In this case, we will delete or anonymize your PI, and the information that will remain public such as games statistics, posts and comments, and block your email address and social media accounts from being used on Chess.com in the future. Anonymized data is no longer considered personal information under privacy laws, it cannot be reasonably used to identify you as an individual.

Please note that in cases where a user's account has been closed due to violations of our Terms of Service, we may retain certain PI, such as the username, in a non-anonymized form. Specifically, if your account was closed for breaches of our Fair Play Policy, we may determine that retaining your username publicly is necessary to exercise our right of freedom of expression and information i.e., in the public interest, particularly to promote transparency, uphold competitive integrity, and deter similar violations.

Please keep in mind that a request to delete PI will lead to cancellation of your Account or the inability to use certain Services.

13. Additional Information regarding Personal Data Processed subject to the GDPR

If you are located in the EEA or the UK, our legal basis for collecting and using the Personal Data described in this Policy depends on the Personal Data we collect and the specific context in which we collect it.

The purpose of this section is to provide you with the information you are entitled to receive under the GDPR and to explain the rights available to you regarding your Personal Data.

a. Transfer Of Data

Your information, including Personal Data, may be transferred to and maintained on servers located outside of the EEA and UK.

Please note that we are a United States based provider. Therefore, we operate our Services, collect and process your Personal Data from the United States.

We will take steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your Personal Data. If we transfer your Personal Data outside the EEA or the UK, we rely on appropriate safeguards to ensure adequate protection, including adequacy decisions by the European Commission or UK government, standard contractual clauses approved by the European Commission or UK Information Commissioner's Office, binding corporate rules and other legally recognized transfer mechanisms, as relevant.

If you are located in countries or regions outside of the United States, including the EEA or the UK, then you have certain rights over your Personal Data, depending upon the area in which you are located. These rights are already outlined in section “Your Privacy Rights“ above.

The right to object to marketing. We only send you marketing communications with your prior express consent or where permitted by applicable law based on our legitimate interests (such as when you are an existing customer and we contact you about similar services). If you have granted consent or we are otherwise legally permitted to send marketing communications, you can object to or opt out of marketing at any time by:

  • Email marketing: Using the unsubscribe button provided in our marketing emails
  • General marketing preferences: Updating your communication preferences in the Notifications section of your Account Settings
  • Targeted advertising: Managing your cookie preferences through our cookie settings or browser controls to limit the use of your personal data for targeted advertising purposes.
  • Right to lodge a complaint to an authority: You also have the right to complain to a Data Protection Authority about our collection and use of your personal data. However, we invite you to contact us with any concern, as we would be happy to try to resolve it directly.
