I know, but from the perspective of the player who is unable or unwilling to realize the benefit of en passant (or tax deductions) it IS cheating. They feel cheated. You hear people ALL the time complain that people cheat on their taxes, when in reality, it's just simple tax deductions that anyone could use. The person who feels cheated says they cant take the deductions because they don't have the deductions to take, so they say it's cheating.
It's really about perspective.
