this seems to be missing some final moves...
for example 37. Kd3 Kg8 38. a3 Kf7 39. b4 and now 39...cxb 40. axb a4 doesnt work because after 41. Kxd4 the king is within range of catching the pawn.
4...h6 is not a good move because it gives white time to castle/fully develop and begin dangerous plans. Black, meanwhile, needs 3(!) moves to castle. 5...Nf6 should of course be met with 6. e5 . Something simple is enough: 6. e5 Ne4 7. Re1 Nc5 8. Nxd4

You don't have to prove anything. Anyone who makes an accusation of cheating just because they lost is a sore loser in my opinion.
If an inoccent man goes to trial for.. let's say burglary, and he know's he is inoccent, he still needs to prove himself, in court, because there is a person who thinks that man robbed his house, so that man has to show proof to the person, so she know he didn't rob their house.

that is correct, just because someone SAYS they think you are using an engine matters very little. cc has said that if your not engine cheating you shouldn't worry about it. the Point is that chess engines play very different than even strong players. you can see this , if you take your typical game and look for the engines top recommendations on every moves. many times they look odd. they are not designed to "make sense" to you, they are picked by an algorithm that ensures they don't lose the game.

No, he doesn't. Innocent until proven guilty.
The prosecutor has to prove that you DID rob the house. And if he does it's your job to proof he's wrong.
if you have to worry about people accusing you on chess-sites, it's like a day job.
Besides, someone who resigns in a (probably) drawn position needs not to be taken serious.
