You must have enough amount of material to win a game by timeout. At least if you have a pawn, then you already win, but if you have a bishop, or a knight, then it's a draw. And this rule is fair, because if you were destroyed by your opponent all the game long, and at the end he loses by timeout, it ain't lose for him, because he didn't deserve this
