how is this not a briliant?

Hello! I think a brilliant has to be forcing move this is a nice sacrifice but unfortunately not forcing and you don't win material either....
Your 22… Qc4? move is a blunder, not a forced queen sacrifice. White does not have to take your queen. For instance, after 23. Qa1 …, there is no immediate mate threat and Black’s attack is over. You had a winning position prior to playing Qc4?. You cannot rely on your opponent to hand you checkmate by making a game losing blunder (23. Qxc4?? … ).
Playing 22… Qxa3 instead would have been devastating for White.
That happens, in one of my games I sacced the knight forking the king and h rook because my knight was lined up with the bishop so bishop discover attacked a rook on b8 as well, so I was winning material either way. But game review marked it as “good”. I find that kinda dumb. Though, since saved analysis is gone I can’t find that game anymore. I think this should be brilliant because it’s either take or lose

because if the peice is defending checkmate then its not brilliant plus if after they take its a mate 1 then its also not brilliant

how is it not a briliant ? i’m playing black and at move 22 i sac my queen to take the rook and checkmate
Because it is a blunder. He plays Qa1, and there is no checkmate.

because if the peice is defending checkmate then its not brilliant plus if after they take its a mate 1 then its also not brilliant
Neither half of your statement is true. There are many examples that contradict you.
Also, as it was pointed out, the Qc4 move in this position is just a missed win. Qxa3 (with the same idea but better execution) just wins, while Qc4 is just equal after Qa1.

it doesn't force him to take it. queen takes a3 would be a brilliant

The move is not forced. For example, if the checkmate were forced, it would not be a brilliant. Here's an example I had several months back

because if the peice is defending checkmate then its not brilliant plus if after they take its a mate 1 then its also not brilliant

well the first half is incorrect the second half is correct its not brilliant cuz they don't have to take taking is just a blunder but my second half is correct because in this position this would not be brilliant
thats only a great move because after you played that move the evaluation is m1 but if it was this position it would be brilliant cuz its m2
and by the way queen moves to h file is an alternative its a position where there's a best and brilliant move because if you move the to the h file they can sack there queen to stall mate making it m2 afterward check in game review yourself
