White is the one who is trying to win in this position, the most black can hope for is a draw. So if white wants a draw, he'll offer it. The worse side shouldn't offer a draw (it's impolite to offer a draw to an opponent who'll certainly refuse it).
Black can offer whatever he wants, but white would probably be unwise to accept.

Also, offering a draw during the other side´s turn is impolite too, because you are interrupting his/her thoughts.
