In theory, if he does not move the king, he should lose on time.
Since the game was declared a draw by insufficient material, there is a possibility that you got disconnected from the server (somehow).
You can try and email Support to ask what happened.
In a 10 minute game my opponent was a bad sport and refused to move his King on the move preceding Mate.
Chess.com has called this a draw (½-½).
