Hans Niemann latest performance

I watched Levy from Gothem review his latest performance in a tourney over seas. His play looked amazing. I believe the old boy is just that good. I don't think he has to do anything extra to win. he can win out right. And many times makes it look easy and forced even against GM'S

I think he was underestimated and won fairly against Magnus.

I'm guilty of falling for all the hype about the game he won against Magnus. However ; I'm guessing when we put folks on a pedestal ; sometimes it's a shock to the system when they are knocked off ; and especially when many of Magnus's games are often seen as foregone conclusions. As time has passed over the last six months ; since all the drama was going on ; I watched both how Hans played in games toward the end of last year and combined with this latest showing ; I'm completely convinced he's legit. Furthermore In my humble opinion ; it doesn't look good for the defendants in this defamation law suit that Hans has put forth. I think the only way he loses the law suit is if somehow the defence presents reputable proof. I haven't kept up with the whole story. Maybe they have proof. But if they don't; then they are guilty of the same thing I did. Not believing it was possible ; and immediately looking wildly for a explanation for what you just watched happen. I think Magnus is so used to handing people their tail in games ; it's just a brain $#@¥ to see someone handing him his own... LoL 🤣

I’m not a lawyer, but I’ve seen some analysis by lawyers, such as Legal Eagle on YouTube. Entertaining guy!

My understanding is that Niemann’s case puts a strong burden on the plaintiff that makes success a long-shot. However, the publicity generated by the lawsuit has silenced some of the criticism of Niemann and that’s already a win.

The timing and language of chessdotcom’s action and Danny Rensch’s tweet about it showed poor judgment. Niemann is not likely to get the financial award for damages that he seeks, but he might get an apology.

The burden of proof is on Niemann, and he has to prove 4 criteria are all true, not just that he didn't cheat. The filing his lawyers submitted was...sketchy. This was all covered before on the forums. His chances of winning the case are slim.

The burden of proof does fall on Niemann regarding his lawsuit. However, regarding the cheating accusation, the burden of proof does not fall on Niemann. One does not have to prove that they didn't do something --- the accuser must show proof.

This is a civil case. We're not talking about his "guilt or innocence". Niemann must prove that the claims made are false, that the defendants (a) knew they were false, and (b) intended to harm Niemann's career anyway, and that actual monetary damages (not potential pipe-dreams of being world champ) are significant enough for a judgment in his favor.

Makes no sense. How can Niemann prove the claims made are false if the claims cannot be proven in the first place? In other words, doesn't the lack of proof of cheating provide enough for Hans to say that the claims are false?

He can't, which is just one of several reasons this lawsuit will not go anywhere. Thanks for playing. Whether he was wronged or not, his chances of landing his million dollars are almost non-existent.

My point is that Hans does not have to prove that he was falsely accused because the lack of proof from the accuser provides that "proof" for him.

Except that it doesn't work that way. Again...civil case. There's no presumption of innocence.

That’s not the way it works. If it is not proven that he cheated, that fulfills step A. Step B is the hard part. He must prove that the defendant knew the claims were false and claimed them anyway in order to defame.
