It seems to me that you're correct, but you might want to send your question to Geurt Gijssen for an authoritative answer (see http://www.chesscafe.com/geurt/geurt.htm).

Hello everbody,
I came across a complex situation two days back in a BLitz (5 minutes each per player) tournament. My opponent had only his King. I just promoted a pawn and had King and Queen. I my move, I made an illegal move and placed the queen on a square to which the Queen cannot move. And my opponent claimed it. The arbiter decided that my opponent should get 1/2 a point for he had no means to win, and I was to lose the game and get 0 points. I was confused and checked the rules. It says in the FIde site :
An illegal move is completed once the opponent’s clock has been started. The opponent is entitled to claim a win before he has made his own move. However, if the opponent cannot checkmate the player’s king by any possible series of legal moves, then the claimant is entitled to claim a draw before he has made his own move.

For me, the rule does not exclusively support the Artbiter's decision. He has interpreted it so, that 'the claimant is entitled to a draw', but the offender is punished with the whole point.
Please help me clarify this please.
Thanks
