Is it against ToS for you to have a higher rated player help you out with your moves in unrated games I think yes but some say no.

No. Any sort of engine or help or any kind in a rated game is forbidden. Unrated may be ok, but it's very unethical. Consider asking the person your playing for permission, if not. Then no It would be very unethical

#9 it's probably hard to detect if the just do it for a game or two
