Repeated moves in turn based chess

I just want to be certain that I know how to get a draw in a turn based game after a position has occured 3 times.

Will I get the draw just by pressing "offer draw"?

Do I have to do it in the position or can I make moves and demand the draw later?

1. Yes!

2. No, you have to claim the draw on the move where the repetition occurs. Note that the position (with the same side to move) does not have to occur on 3 consecutive moves; it could for instance occur on moves 30, 33 and 36; on move 36 you can claim the draw, or any other subsequent move when the same position / same player to move occurs.

I offered a draw in this game where it is my turn to move. Could you explain why it was not a draw by repitition. As I see it it is the same position on my move 38, 42 and 44.

There is a bit of a flaw. You have to do it after making the move, but if your opponent has set a conditional move you miss the opportunity.
