If someone keeps repeating the same move and forces a stalemate. They should lose. Come back with your shield or on it. Draw? Tie? Cause you can’t win you force a tie. All the years of chess and this is the best solution???

It takes two players to repeat the same moves. They both should lose by your logic. And if they both lose, then they both don't win. Stalemate.
