Ratings change. Some players may enter for a tournament when they are within the limits. Then they play a few online games before the tournament start so when it does start they have a higher rating. They're not chucked out of the tournament because of it (unfortunatly).
I know how you feel! I was in a tournament about a week ago for 1000-1199 or something like that and suddenly I have to play a guy with a rating of 1600

he may be going down to 1100 from 1600 after he comes back, you cannot blaime someone for fighting back his rating.
I doubt that anybody would sandbag just to win a 1200 rated tournament.

It is a big problem, though, else so many players wouldn't complain.
As for sandbagging, I don't think there's much of that, the problem is that players without established ratings are allowed into large tournaments, and as they continue to improve you end up with 30 or 40 players hundreds of points above the maximum entry. It is impossible for a real 1190 player to win a 1000-1200 official chess.com tourney, when actually he should be one of the favourites.
As for players losing a lot of rating points after mass resignations/timeouts, this is another issue which should be explored. Rating should be a measure of playing strength, not timeout reliability. An 1800 who drops to 1100 because of this does not punish the player, but his opponents. Maybe a rating floor 200 points below your maximum should be introduced. And also, I agree that he should fight to get back his rating points, but entering such a low rated tourney when he knows his own strength seem a little dodgy to me.
There is NO WAY a player with establised rating could win a large tourney, that seems wrong to me.
If a player timeouts more than 5 games in a row, I think only the first 5 are rated to keep the ratings accurate. However, this of course only works with basic members, or premium members who have run out of vacation time.
I cannot back this statement up but I believe the five game floor on the rating was dropped. The last I saw in the forums there was a five game floor on the rating used for the calculation of the winner's rating. That means the player timing out goes into freefall.
Platinum and diamond members can see the freefall in June 2011.

Some T.D"s after observing ratings way above limit: at time of registering , ask other players to not make 1 move in game against obvious (way above limit) competitor ( "s ) and that they will be removed , not rocket science to check online history of opponents. a player AFTER registering who rises in ratings has every right to be in tournament .

register for a tournament with a ratings limit, and find out players with far higher ratings are accepted, might as well have every tournament open-rated. seems like sneaking in the back door is one way of winning. I realize players can gain points after registering, but 168 points in 24 hours is sus. 700 rating- rise in 5 days is fantastic ;; ELECTRONIC ASSISTANCE ???????
