Why do you need to be in Check to be Checkmated?

I have been thinking about the ginger hair step child of chess, the Stalemate. The Stalemate is a draw through smothering, a draw out of defeat through the silly safety of being fulling immobilized so that the rules of chess crumble leaving the contents of the game as fruitless. 

 ok... that might be a bit overdramatic but why must there be a difference between a king having no means of escaping check while being checked and a king having no means of escaping check. The etymological root of Checkmate roughly translates to "the king is helpless," Isn't a king with no legal moves helpless?

I mean you can blab about how it gives a chance for a losing player an opportunity to avoid a loss. I don't really care. We can agree that a a ruler isn't safe from their enemy when immobile.

i have an alt solution, If you are stalemated nothing happens, the game doesn't end, you have to resign or wait for your timer to end. this doesn't really work without a timer and isn't a good solution but i think a player holding a casual game hostage because they are too stubborn to resign is hilarious.

I see it as the King is safe in a stalemate situation and doesn't have to move into danger. So it will just remain in it safe haven that was created by your own pieces.

Stalemate is a good part of the game, can win you a tournament as well as lose you one.......
