Why is this a draw?

Hi guys, I got a three fold repetition draw, but I thought the game would carry on as the last 3 moves weren't identical. What do you think? here are the last moves
38. Rf7 Rxh2
39. Rf6+ Ka7
40. Rxh6 Rxh3
41. Rh7+ Kb6
42. Rh6+ Ka7
43. Rh7+ Kb6
44. Rh6+ Kb7
45. Rh7+ Kb6 1/2-1/2
From move 41 on, only the white rook and black king are moving so we can ignore the other pieces and pretend there are no other pieces (good thing since you didn’t include the whole game or complete board position)
At the end of move 41, R is on h7, K on b6

At the end of move 45, R is on h7, K on b6
