ISNT THIS GAME A DRAW BY 50 MOVES?!

The draw is not automatic. It must be claimed, by pressing the draw button. Anytime from move 74 to 121. Actually even before that, since threefold repetition can also be claimed, and again is not automatic.
Even in OTB real life tournaments, 3-fold and 50-move draws are not automatic or compulsory; one player must make a claim to the arbiter for the draw to be awarded. Although in practice most players just agree to a draw between themselves, no need to bother the arbiter unless one player is being stubborn about it.

Asakshar,
I believe this is the game you were referring to in your post. It is not a draw by the 50 move rule as much as it is a third time a position has occurred on the board. The game should have been declared a draw. But I know chess servers often have a problem recognizing a three-time repetition unless it happens on consecutive moves, which believe it or not, doesn’t appear to happen in this game.
The game below is the game in question. The repetition of moves start on Black’s 26th move.

slaca,
Sometimes the draw button doesn't appear. And most of the time the draw button appears, it is to OFFER a draw, not claim one.
And the server has forced a draw at times, when it is the player's responsibility to claim a draw, not the server.
I based my answer on those assumptions.
Thank you for your input! =)

When I press offer a draw or draw button, dont know exactly the name, it will be automatically draw, in cases like this.
