Why am I being punished because of a cheater?

I played in a 960 chess tournament and at second round I lost only two games against a player who happens to be a cheater. Since I finished my games before he got caught, I am at the second position in my group and he is still at the first. I lost my points and elliminated from the tournament eventhough I won the rest of my games. 

Is this fair? I am paying for the membership and getting punished by chess.com because they say what's done is done so I am elliminated. Please, can someone explain this to me?

Chess.com is a POS on the subject of cheating. I had a guy who was cheating against me, bragged about cheating on the chess chat, and they did NOTHING, even though I am a paying member and he is not.

They are arrogant in the way they deal with people too.

You`re right Abraham the games are viod and his account is closed. He had 4 points I had 2 points and the other player had 0 points. If the games between him and any player are void then I am the one who has the highest point in the group now. The tournament round is not finish yet so I am not talking about something happened 2 or 3 rounds ago it is just happaned so why do not they correct that thing?

Yeah all their games from that round should be resigned.

Punished? Were you fined? Did you spend time in jail? In what way where you "punished?"

A punishment, a fine, and spending time in jail are different things. Last two are types of a punishment.

In what way were you punished? A punishment impliees the imposition of something unpleasant or negative in response to unwanted or unacceptable behavior.

Nothing was imposed upon you. You did lose those games. You did not win those games. They may have not have compensated you for having played against a cheater, but they imposed no punishment upon you either. And those are not the same thing.

I'm pretty sure that you will still go through at the end of the round if his account was closed. Unfortunately the rating points won't be returned.

I don't understand you David, punishment is punishment. Not beeing able to advance to the next round is a type of punishment if you had the second place because the first place was occupied by a player who cheated on the group games and also whose account is closed because of cheating. Isn't that simple? I showed them another example in another group the first place there is a player whose account is closed because of cheating as well and the green arrow indicates the second player and he will advance to the next round. They say the games have not been finished before they caught him! Is this logical to you?

@OP: The games you lost to the cheater must stay as losses, because Chess.com policy states that past games' results must stand. One of the reasons is that determining precisely in which games cheating occurred is far too time-intensive and complicated. Therefore, specific games' results cannot be overturned.

@skfan: Your opponent may have been bluffing about cheating, in order to try to anger you. If your opponent actually cheated, Chess.com would have banned him, or will imminently do so.

Dan I am not saying that they should overturn the results. I am wondering why I will not be able to advance to the next round.

From what you described, the next round apparently got underway before the cheater was nabbed. Games in progress cannot be cancelled, reset, or voided in order to "correct" this situation, because it would affect all other participants. The pairings would need to be reconfigured, and all the games would be reassigned. This would create a complicated mess, and the other participants don't deserve such an upsetting delay, as they are minding their own business.

This is why the second-place participant can only advance before the next round begins.
