@OP: In Chess, we must look at the whole board and be fully aware of the game's situation. For example, if I am in time pressure during a game, then my responsibility is to notice that. I must look at the clock. If I neglect to do so, I have nobody to blame but myself, especially if I lose on time.
In Online Chess, the draw offer should be displayed toward the top of your browser window. It is just one feature of which you must be aware. Chess.com's responsibility is to display it. Heeding it is yours.
What browser and system do you use?
By the way, your suggestion of requiring a refusal before continuing the game would be inconsistent with convention. In official tournaments, if White (for example) offers a draw, and Black moves without answering, then Black's refusal is presumed.
@[all]: The OP is talking about draw offers in Online Chess, not Live Chess, folks. Let's keep all comments relevant to that aspect.
