Can players sue chess.com if there account is closed for cheating if the subject player wasn't cheating ?

Anyone can sue anyone else over anything: the question is, what's their chance of success?

In this case, zero to nothing: Chess.com is happy to review any instance of account closure, but if after the review the account remains closed, they're fine with taking that decision to court if they have to - that's the level of confidence they have to have when they close an account for Fair Play violations.

since ve been at cc ive only known one person who had their account re,instated ,after closure for suspected engine use , there was a few here willing to get the appeal in motion , this entailed the banned player getting proof of their chess ability from their coach , as far as im aware they didn't sue cc but just got back to doing what they do , and that's play chess well

we all make mistakes and sometimes it can cost us , I tend to find cc the best site for spotting engine use though but even they can make a wrong decision ,

I would certainly try to convince players with high grades , to first have the email of their senior admin , (send them an email to get theirs in reply ) this will mean communication is still open whilst a ban is in place , then to have proof of their ability via a coach , or by say the notation of their last ,,,say 10 ,,,5 , otb games , lower grades the same but they stand to lose less income /reputation , which is the only two reasons I see for suing ,

Your suggestion is nice except it leaves out the fatal FLAW that not everyone plays OTB. For an online-exclusive player, the player is completely at the mercy of the crackerjack Fair Play team. In my successful APPEAL, I offered explanations of my system and how my unorthodox play generaly works, which they must have accepted. But yes, they first were demanding an OTB rating, etc. What JOGWASH. Not that my opinion counts but I feeeeeel the burden of proof should be on them to pony up actual evidence in regard to (False) allegations. What specific games were suspected of computer assistance? Which moves? Why? And so on. They don't provide any of this. I'm just trying to inform others.

I have this discussion in another  group and someone brought up a good point. Say I have a repertoire ik through and through and have done computer analysis on it etc... And I manage to beat a GM on chess.com correspondence am I just doomed to be banned ? What are some ways a player can go about proving there innocence in correspondence ?

jklenear , im sure david will correct me if im wrong but cc bans for engine use are based on a collection of games and not just one , like you I see how a player who has mastered a line might be assumed to be cheating as they play the perfect game , but that one perfect game isn't cause for a ban , its when they do this consistently ie play the perfect game every time in the games cc look into before deciding ,,,how to verify your ability without otb reference or coach backing ,,,,, cant answer that other than to get the otb rating and perhaps a coach

Actually, it IS possible to identify engine use in the case of even just one game, but that wouldn't happen in the case that @jklenear describes.
