Hi mbablus84, The situation you have given has two solutions. If you are playing in international standard I.e. You start by the pawn pushing two steps then you can't kill it rightaway after the next step of white only black can take any action otherwise cant and specifically it can't be killed rather it is functional just in case king is in a position to give check to. Otherwise if you are playing other manner I.e. Pushing pawns to one step then you can kill it. The black rook can kill the white queen. Hope this answers your question. Thanks again.
