The position isn't legal with White to move.
The position is checkmate. The King can not move into a square that puts it in check and can't remain in a square that is attacked by the opponents pieces(s).
Therefore, you can not take the Queen as that would move your King into check. Since the King is unable to move out of check it is checkmate. The Rook being pinned to the White Queen is meaningless in such a situation.
I think we had a similar question come up recently. It doesn't matter if the rook is pinned, because the black king taking the queen puts it into check. And if you were to follow through with actually capturing the king, the black king would be captured by the white rook before the white king would be captured by the black bishop. Once the black king falls, game over.

i have a conundrum that i encountered in the last game i played regarding a specific sort of checkmate scenario. i'm not sure if there is an articulated rulebook anywhere, but i was wondering about this sort of situation:
basically, i achieved a checkmate like this (there were other pieces on the board, i'm just excluding them). i know that you can't put your own king into check and i am wondering about this sort of loophole- if the black king captured the white queen, the white rook wouldn't be able to move because of the black bishop. so, realistically the white queen isn't protected. i kind of scratched my noggin after this one and figured that there would be some rule addressing this situation. i mean, yea, you can't move your king through an attacked square, but this just made me wonder. kind of a lame checkmate! haha
