This based on over 18 months a Cheat Forum (CF) group member (only), observations based on reading every CF Note posted in that time frame, pertinent to this question CF Forum Topic posts:
Cheat icon (tiny blue shirt/red sign guy), posted immediately after an avatar, at game records of, VCs playing in at time of ban, are placed their by site staff through their cheat ban protocols; Some then 'disappear' within hours (rare), days, weeks, months in a way that does not suggest 'site software glitch'; account almost always, like high 99%+ of time, remains closed.
Some of the real people, that held the original banned avatar account, are allowed to reopen new accounts with new avatars through some system chess.com staff has for doing that; Their site, their right to do so; But many believe, besides me, that for cheat icon to disappear, real person has to acknowledge 'past banned behavior to staff' (through email exchanges), before icon 'removed'.
This is all my opinion only, (but many other active CF members support 'similar opinions' of their own); I doubt very seriously, that anyone can get site staff to publicly acknowledge any of this (which I wholeheartedly agree is within THEIR rights) as part of the overall view has to be protection of privacy of real persons who have admitted mistakes, being given another chance.
A friend of mine got banned for saying merry Christmas to too many people too fast.

I've been slammed by the autobot, and one member, BigFatDaddy55, had a habit of getting blocked by the spambot quite habitually. Being in dozens of groups, for instance, he'd leave a note in each group saying "Good morning" or something of that nature, then he'd get SpamBotted. Othertimes, he'd post mulitple short notes in quick succession and get spambotted again. In such cases, one generally only needs to contact Admin team and explain the situation. I found pawnsolo to be anything except a hack; he seems bright and intuitive with a knack for cutting through political correctness to the heart of the matter without offending others in the process.

You cannot accuse players of cheating in public. You can report any you have suspicion to chess.com. There have a very effective anti-cheat program they can run on suspected cheaters.
