They need to fix this, three move repetition for a draw.. made me lose when it should have been a draw

This type of draw must be claimed by one of the players.  If neither you nor your opponent made such a claim, then there isn't a draw.

The rules regarding threefold repetition have not changed. It must still be claimed.

FIDE added a new rule (9.6) in addition :

If one or both of the following occur(s) then the game is drawn:

  1. the same position has appeared, as in 9.2b, for at least five consecutive alternate moves by each player.

This is a different rule as it requires five consecutive repetitions, and the game will be drawn automatically. Whether chess.com has implemented this I do not know. I also do not think USCF have adopted this additional rule, so if chess.com follow USCF rules it wont be implemented.

I had losing position but with a bishop and a queen, the king had only 2 squares to move to, and i repeatedly checked the king. But since I was down on time, and the draw was not implemented, I eventually lost.

Well, you will know in future that you need to claim the draw.

That link gives the following advice:

"Once the position has repeated three times, make your move then click on the 'Draw' button. This ends the game as a draw."

I'm quite surprised it states this. The problem with first making the move which results in the threefold repetition and then claiming the draw is that your opponent, if fast enough, can make a quick move in between so that the position is no longer three times repeated.

My method is to click on the "draw" button first and then play the move. When the move is played repeating the position for the third time, the server notes that you have already pressed the "draw" button and converts what was simply a draw offer into a draw claim.
