If a TD doesn't enforce a thematic tournament can anything be done?

For example, in the Caro-Kann Bayonet tournament, the initial moves were not put in by the TD and now several players are being sneaky underhanded sods and playing whatever they want, even when their opponents stick to the theme for the initial moves. Thus the sneaks get an unfair advantage and those following the theme get a compromised position. 

Can anything be done? Can we just annul those games? Or is this a case of tough cheese, take note of the TD's name and never play in one of their tournaments again?

If you read the comments on the tournament page, the fact that the TD had made a mistake in the setup and that people were not following the tournament theme was clear 10 months ago.  (You made one of the comments.) The TD apologized and said he would try to fix it for the next round. Evidently, he was not successful.

One of the tournament leaders withdrew after the first round. (See the standings.)  I think it is too late for you to withdraw without it counting as a loss for all your second round games.

Yup, and the TD said he'd fix it. He hasn't, and several players have taken unfair advantage of that.
