Depends on the time controls... It is annoying, but some people legitimately are thinking, and Chess.com doesn't want to boot them off their game.

If you want time to sit procrastinating for hours on end, you don't pick someone else's 10min creation.

I get what you're saying. But these aren't players thinking - in one case recently they had two pieces left (one a pawn) verses my army of pieces including two rooks and a Queen and I was explicitly one move off putting him or her in check mate.
Perhaps an alternative solution is if I could start a second game while the clock ticks down. I don't think, at present, you can do this?
I'm noticing there's a growing problem on this site of players getting to a position in a game whereby they've almost certainly lost with several minutes to go then stopping moving. I've just had a player not move for 2min before the game aborted. I've also had players disconnect repeatedly which over-rides the abort game feature. Can we have it that if a player does not move for a minute, the site automatically declares them as having lost the game? These people need banning from the site as they're ruining it for those of us who come on to play chess, not stare an an inactive computer screen for several minutes on end.
